Terms & Conditions of Purchase

Effective from date of purchase : These Terms and Conditions (“Agreement”) govern the subscription-based design and illustration services (“Services”) provided by LM Art & Design (“Company,” “we,” “our,” or “us”) to the Client (“Client,” “you,” or “your”). By subscribing to our Services, you agree to these terms. 1. Services Provided We will provide design and illustration services as described in the subscription package selected by you.

2. Subscription Term Subscriptions are billed on a [weekly/monthly/quarterly/annual] basis as agreed upon at the time of sign-up. The term begins on the date of payment confirmation and renews automatically unless canceled as outlined below.

3. Payment Terms
• Payments are due weekly in advance.
• Failure to make payments on time may result in suspension or termination of Services.

4. Cancellation Policy • Notice Period: You may cancel your subscription by providing at least 14 calendar days’ written notice before the next billing cycle.
• Immediate Cancellation: If you wish to cancel without providing the required notice, you agree to pay an immediate cancellation fee of $2,000.
• Notice of cancellation must be sent via email to lmiddletondesign@gmail.com.

5. Refund Policy
• Fees paid are non-refundable except as required by law.
• If you cancel your subscription with proper notice, no further charges will be made.

6. Scope of Work
• The Services provided under this subscription include design, formatting and illustration services, including infographic and proof reading as needed
• Additional services outside the agreed-upon scope may incur additional charges.

7. Client Responsibilities
• Provide all necessary materials, feedback, and approvals in a timely manner.
• Ensure that all content provided to us complies with applicable laws and does not infringe upon the rights of any third party.

8. Intellectual Property
• Upon full payment, you are granted a license to use the final deliverables for their intended purpose.
• We retain the right to showcase the work in our portfolio or marketing materials unless otherwise agreed upon in writing.

9. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the term of the subscription.

10. Termination We reserve the right to terminate the subscription if:
• Payments are not received on time.
• There is a breach of these terms. In such cases, no refund will be provided.

11. Limitation of Liability Our liability is limited to the amount paid by you for the subscription term in which the issue arises.

12. Governing Law This Agreement shall be governed by the laws of New Zealand.

13. Dispute Resolution Any disputes arising under this Agreement shall be resolved through mediation before seeking legal recourse.
